🏔️ Tenzing Norbu Bhutia, 31, runs Dzongu Cup on MG Marg, Gangtok—18 seats, momos, thukpa, Temi-estate pour-over. January 2025: Tourism Department renewal blocked by new composting requirement (no certificate), FSSAI renewal unsubmitted (FoSCoS email November said Kolkata routing, unclear if digital-only was acceptable), SBI MUDRA loan (₹4.5 lakh, two months into processing) requiring three documents: Udyam cert, valid FSSAI, clean Tourism permit. 🚨 The problem
Three regulatory changes converged: (1) August 2024 Tourism Department circular STDC/Eatery/2024-25/87 revised the renewal process—now requiring two-office submission sequence (Compliance Cell first, then district office), and mandatory Plastic-Free Compliance Certificate from UDDHD. Circular posted on notice board, never mailed to permit holders. (2) FSSAI November 2024 email noted North-East processing via Kolkata, ambiguous on whether digital submission alone was sufficient or if physical documents were required. (3) FSSAI penalty: ₹100/day (days 1–15), ₹200/day thereafter. By February, penalty was ₹5,800 and climbing.

Sikkim has fewer than 700,000 people; Gangtok tourism zone has several hundred food businesses. The August 2024 circular was legitimately issued and publicly posted. The implementation—two-office sequence, new certificate requirement—created a gap that had nothing to do with regulatory intent. The FSSAI email routing instruction was a communication mismatch: Kolkata bureau versus digital submission. The Swachh Vyapar self-declaration option existed on a portal not mentioned at the walk-in counter. Small gaps, each invisible until they become a penalty clock running at ₹200 per day.
