🚨 The problem

Sikkim's Restricted Area Permit (RAP) — governed by the Foreigners (Restricted Areas) Order 1963 and reinforced by 2019 and 2022 Sikkim Tourism Department notifications — applies to foreign nationals conducting any commercial professional activity in the state, including filming and brand shoots. A tourist e-Visa covers entry and sightseeing. It does not cover setting up a commercial camera in a monastery courtyard with a four-person professional crew.

The fine under the Foreigners Order 1948, Paragraph 7: ₹40,000 per foreign national in violation. Four crew members. Total penalty: ₹1,60,000. Shoot suspended for the remaining two days. The brand's contract had a "creator's failure to secure necessary permits" clause: 30% fee reduction available. Fee at risk: approximately ₹4,40,000. Combined exposure: ₹6,00,000.

The agency in Delhi had assumed the brand handled permits. The brand's coordinator in Sydney had Googled "India visa Sikkim" and found the PAP rules for Indian tourists — a different framework entirely, not applicable to the crew.

Between 2019 and 2024, the Sikkim Tourism Department issued 847 RAP violation notices to commercial crews. The pattern is always the same: the brand handles the visa, the creator handles the location, and the RAP obligation falls in the gap between them.

Every creator in a restricted-area state — Sikkim, Manipur, Mizoram, Arunachal Pradesh, the Andamans — who takes an international brand partnership with a foreign crew is operating in a permit zone.
