🚨 The problem

Pangong Tso is a Protected Area Permit (PAP) zone under the Foreigners (Protected Areas) Order, 1958. After the 2019 Jammu and Kashmir Reorganisation Act, Ladakh became a Union Territory and MHA revised the PAP procedures under the new UT structure. Every foreign national entering Pangong, Nubra Valley, or Tso Moriri for any purpose — tourist or commercial — needs a PAP issued through a Leh-registered tour operator, minimum seven days in advance. A tourist visa does not substitute. A commercial shoot does not get an exception. Ladakh Police maintain the checkpoint at Man village and do not negotiate.

The Swiss crew — creative director, director of photography, styling coordinator — had tourist e-Visas. No PAP. No tour operator. No prior application. The equipment was held at the barrier: two cinema cameras, a drone, a reflector rig, two watch cases. Fine exposure: ₹46,667 per person × 3 = ₹1,40,000. The brand's contract penalty clause — "creator's failure to obtain necessary permits" — was already being reviewed by the Geneva production office.

Two separate problems had been accumulating in the background. First: Stanzin's SBI Leh account had received USD 6,200 (first tranche) in February with no Foreign Inward Remittance Certificate — the FEMA-required document for any service-export foreign payment. The bank had called three times. She had not known what a FIRC was. The second USD 6,200 tranche was due from Geneva in two weeks. Second: Ladakh UT became a separate GST jurisdiction from J&K after 2019 — a fact no Delhi influencer agency had briefed her on. Her FY 2024-25 aggregate turnover was ₹22.4 lakh, above the ₹20 lakh threshold. She had no GST registration. Late-registration penalty: ₹10,000 or 10% of tax due, whichever is higher.

Three compliance failures. One hard stop: 4 p.m. for equipment release.

🇮🇳 Why this matters

Pangong, Nubra, Tso Moriri — the locations that make Ladakh content look the way it looks — are all PAP zones. Every Ladakh creator taking an international brand partnership with a foreign crew is operating in this framework. The reorganization of 2019 created a Ladakh UT GST jurisdiction that most Delhi agencies still file under J&K assumptions. The FEMA inward-remittance procedure is invisible until the bank calls. The PAP requirement is invisible until the checkpoint sub-inspector asks for the permit.

None of these gaps require wrongdoing to fall into. They require only the absence of someone who reads the 1958 Order and the 2021 DC circular with you — before the Man village barrier — and tells you what to file, and when, and in what order.
